After admitting guilt to assaulting his ex-girlfriend Chiara Passari during a night out in Canberra, Nick Kyrgios will not be convicted.

The Australian tennis player appeared before the ACT Magistrates Court on Friday; after failing to have the matter handled on the basis of mental health, he entered a guilty plea and had his case dismissed. In a verbal altercation more than two years ago, the world No. 20-ranked man, then 27 years old, pushed Ms Passari to the ground and was later charged with common assault.

If actually convicted, the maximum term for the crime was two years in prison. Kyrgios appeared on the court with his family and his current partner, Costeen Hatzi. He just underwent surgery after withdrawing from the Australian Open on the first day of competition due to a tear in his knee cartilage. Kyrgios’ request to have the assault accusation handled in accordance with section 334 of the local Crimes Act, which would have resulted in the case being dropped on the basis of mental health, was rejected by Magistrate Beth Campbell.

Kyrgios’ accusation was ultimately dropped by Ms. Campbell, who stated that she would handle his case similarly to that of any other young man accused of a “low level assault.”
